BILBAO EXHIBITION CENTRE, hereinafter BEC, with registered offices at Ronda de Azkue 1, 48902 Ansio-Barakaldo and tax identification code (NIF): ES A-95135984, is the owner of this website or portal and places it at the disposal of Internet users so as to provide information to visitors about BEC services, congresses, shows, exhibitions and other events, as well as to open up a new channel for communication and to provide services between these visitors, exhibitors and BEC.

Access to all pages and domains on this portal is free of charge and anonymous, except in those areas where, for security reasons, the user is asked to register before access.

GENERAL CONDITIONS OF USE OF THE PORTAL

Access, Industrial and Intellectual Property, and Hyperlink Policy

Access to and use of the services contained on this portal are voluntary and entail the full acceptance of the general conditions of use expressed in this document.

Browsing and use of the portal services mean acceptance as a user, without any reservations whatsoever, of all the general conditions of use. BEC will be entitled, at any time and without prior notice, to modify these general conditions by publishing the said modifications on the portal so that they known in advance by users.

The user undertakes to use the contents (brands, trade names, industrial designs, designs, texts, photographs, graphics, logotypes, icons, software or any other signs capable of industrial and commercial use and which are protected by industrial and intellectual property rights belonging to BEC or third-part holders who have authorised their inclusion on the portal) and services provided on the portal correctly and legally.

To this effect, the user undertakes not to copy, distribute, transform, modify or manipulate the contents, nor to interfere in any way with the technical devices for portal protection and configuration.

BEC will not be responsible for any breach of the intellectual or industrial property rights of third parties that might arise from the inclusion of brands, trade names, industrial designs, designs, texts, photographs, graphics, logotypes, icons or software belonging to third parties which have stated they are owners of such when included on the portal.

In the same way, the user will refrain from carrying out activities which might damage, render useless, overload or deteriorate the pages, or prevent normal use or enjoyment of the portal and services by other users.

The user will not be able to establish hyperlinks from another website without the prior express authorisation of BEC.

BEC will not be responsible for the contents of destination websites which are established by means of links on the portal nor for breaches of the rights of third parties that might involve such websites.

Personal Data Protection

Pursuant to LOPD 15/1999 and LSSI-CE 34/2002, interested parties are informed that personal details which are provided voluntarily, including e-mail addresses, shall be incorporated into an automated file which is the property and the responsibility of BEC (a file which the General Register of the Data Protection Agency has been notified of). On sending their details, the parties in question expressly authorise the use of the same for the undertaking of periodic communications, including those made via e-mail, which BEC will use to provide information on trade fair business –activities, contents and services– which it undertakes itself or through collaborating companies. Likewise, the parties in question are informed that their details may be communicated, with a confidentiality obligation, to the companies which collaborate with BEC, exclusively for operational and management purposes deriving from a contractual relationship, including their background, contents and development.

User Consent: The user accepts the inclusion of data gathered during browsing through the portal, or provided through completing any form included on it, as well as those arising from possible business relations that might be created, in the above mentioned automated file of personal data.

Cookies: BEC informs the user that in order to access some parts of the contents of the portal it might be necessary to first complete an enrolment form, or similar, on which the user will be requested to insert personal data. In the same way, and with the aim of improving its services, BEC will be entitled to activate cookies programmes, by means of which user data are obtained.

BEC Liability Disclaimer

BEC does not control, at all times, the use that users make of the portal and consequently, will not be liable for any actions carried out by users of the portal that breach the stipulations of this document.

BEC does not guarantee that its portal or the server that provides it are virus-free or, in the same way, any other items that might cause disturbances in the user’s computer system due to third-party action or due to the setting up of unauthorised hyperlinks by third parties.

Nonetheless, BEC states that it has taken all necessary measures, within its possibilities and the state of the art, to guarantee the correct operation of the portal and to prevent the existence and transmission of virus and other items that might be detrimental to the user.

BEC can not guarantee the accuracy of its contents nor their continuity, and reserves the right to unilaterally make partial or total changes or alterations to them, as well as to interrupt or suspend access when it considers appropriate.

Portal Brochures

On its portal, BEC has pages where the user can consult the brochures of some events which have taken place recently or are going to take place in the near future. These brochures refer exclusively to the specific event they deal with and include data provided by exhibitors so as to make users aware of them through said brochures.

BEC declines any responsibility regarding information provided by exhibitors, who are solely responsible for its veracity and licitness.

Applicable Legislation

The relations established between the user and the owner of the portal will be governed by the stipulations of the regulations in force concerning applicable law and competent jurisdiction. Nonetheless, for those cases in which the regulations envisage the possibility of the parties submitting to jurisdiction, BEC and the user, expressly renouncing any other jurisdiction that might correspond to them, submit to the Courts and Justice of Bilbao. In any case, the regulations of the Spanish Legal Code will be applicable.

GENERAL CONDITIONS FOR CONTRACTING THROUGH THE PORTAL

These General Conditions for Contracting, together with the specific conditions which might be established, will expressly regulate the relations that arise between BEC and exhibitors that contract the services offered through the portal.

On its portal, BEC has a direct communication channel with exhibitors at its events. It is an interactive service accessible from the website of each event organised, which the exhibitor can enter and consult interesting information concerning its participation.

User Number and Password

The user’s exclusive user number and password, provided to exhibitors by BEC, must be used to access this area. These will be provided in sufficient time prior to the holding of the event they are taking part in.

BEC will notify details of the user number and password to the person representing the exhibitor in dealings with BEC. This data is confidential. It is the exhibitor’s responsibility to prevent incorrect use of this data by third parties and BEC can not accept any liability in this respect. BEC will be entitled to carry out modifications, after prior notice to the user, after which the altered codes will no longer be valid.

Conditions for Access:

In order to access this area, only the user data provided by BEC must be used. When the user number and password are entered, the system will check that the combination is valid.

If the said combination is not valid, the user will be informed by the corresponding message.

When the user has made three erroneous attempts to gain access, the account will automatically be blocked. In order to unblock the account, the user should send an email to [email protected].

General Conditions

These General Conditions have been drawn up in accordance with the provisions of Law 7/1998 of 13 April, regarding General Conditions for Contracting, Royal Decree 1906/1999 of 17 December, governing the general terms of contracts made by telephone or electronically, in development of article 5.3 of Law 7/1998, Law 26/1984 of 19 July for the Defence of Consumers and Users, Law 7/1996 of 15 January on a Regulator Framework for the Retail Trade and, if applicable, Law 34/2002 of 11 July regarding the Information Society and Electronic Trade.

Provision of any of the services on the portal means acceptance by the user of each and every one of the General Conditions for Contracting, of the General Conditions of Use of the Portal, as well as the Specific Conditions that govern service provision published on the websites of the corresponding event, if applicable.

BEC informs that the procedures to achieve provision of the services offered are as described in these conditions and those detailed on the screen concerning each specific service.

All the information provided to BEC during the contracting process will be stored so that the user can request information regarding the operations it has carried out in the preceding 3 months and always after a request has been sent to BEC by fax or e-mail.

All the technical means which are required to access the portal and for the provision of services by BEC will be exclusively at the user’s expense, as will any tax or expense of any other nature incurred by providing the said services.

Contracts entered into through this portal will be governed by the regulations in force concerning applicable law and competent jurisdiction. Nonetheless, for those cases in which the regulations envisage the possibility of the parties submitting to jurisdiction, BEC and the user, expressly renouncing any other jurisdiction that might correspond to them, submit to the Courts and Justice of Bilbao.
